AGREEMENT

for the collection, processing and storage of personal data

The user, leaving an appeal, an application on the site https://jlc.kz/ (hereinafter also referred to as the site) gives his unconditional consent to Unilactis distribution LLP (Unilactis Distribution), (hereinafter referred to as LLP) and third parties who have and (or ) may be related to the activities of the LLP, including the conclusion of an offer agreement between it and the LLP, for the collection and processing of personal data, both on paper and in electronic format, in arrays and (or) databases of the LLP.

1. Personal data is any information related to the user, recorded on electronic, paper and (or) other tangible media, which may contain (including, but not limited to):

• information necessary to open a personal account on the company’s website and proper identification (last name, first name, patronymic); email address, delivery address, contact phone number);
• name of the legal entity; legal address; bank details, BIN, data of the head of the legal entity (to the extent provided for in subparagraph 1) of paragraph 1 of this consent);
• information necessary to maintain communication (place of delivery), phone number (work, cell), email address);
• information related to the provision of services by the LLP within the framework of the agreement between me (or the person whose representative I am or may be) and the LLP – texts of contracts (agreements), additional agreements thereto, statements and consents, correspondence, title documents, etc.;
• information about the purpose and nature of the business relationship;
• other information necessary for the LLP to conclude an offer or sale and purchase agreement, and to form the Client’s dossier in accordance with the requirements of the legislation of the Republic of Kazakhstan and internal documents of the LLP;
• information about the change and (or) addition of the above data.

2. Collection, processing and use of my personal data (including collection, processing and storage on paper and (or) in electronic format in arrays and (or) LLP databases), including for the following purposes:

• for the conclusion, commission, execution of an offer, a contract of sale;
• for the LLP to fulfill the obligation to store and record primary documents used in accounting within the time limits established by the legislation of the Republic of Kazakhstan;
• for judicial and extrajudicial protection of the rights of the LLP: (1) in case of violation of obligations under the relevant agreements; (2) in case of disputes, including disputes with third parties;
• to place public (disclosed) data and information in the media in compliance with the requirements of the legislation of the Republic of Kazakhstan;
• to provide reporting and (or) information to authorized bodies, audit, evaluation and other competent organizations;
• for the purpose of identifying and providing access to the premises or offices/information systems of the LLP in the manner and subject to the restrictions provided for by the internal documents of the LLP, to ensure the security regime of the LLP;
• for the exchange of information, including for consideration and (or) providing answers to my and (or) third parties’ appeals, complaints, proposals, claims, instructions, etc., sending (receiving) correspondence (mail) addressed to me (address of the person whose representative I am or may be) for sending (delivery)/receiving via courier services, courier service, express mail, etc.;
• for marketing purposes, providing (sending) to me any information and promotional materials, including about the products of the LLP, as well as other notifications of the LLP via telephone, facsimile, other types of communication, as well as through open communication channels (including SMS, e-mail, fax, etc.);
• for other purposes, which are established (may be established) by the legislation of the Republic of Kazakhstan;

3. Hereby, the User confirms that:

• notified of the protection of my personal data and familiarized with the Regulations on the protection of personal data of Clients and the list of personal data of LLP Clients;
• LLP has the right to collect and process personal data without the consent of the user in cases established by the laws of the Republic of Kazakhstan, including in other organizations for the purpose of carrying out any activities not prohibited by the legislation of the Republic of Kazakhstan;
• The LLP has the right to collect (receive) personal data from any third parties, as well as transfer personal data to third parties / distribute in public sources of personal data, subject to the requirements of the current legislation of the Republic of Kazakhstan and the requirements of international law (requirements of international treaties);
• this consent gives the LLP the right, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, to carry out with personal data any action (operation) or a combination of such actions (operations), including those performed using automation tools or without using the latter, including, but not limited to, collection, processing, recording, copying, backup, protection, systematization, accumulation, storage within the LLP and outside it (subject to security and confidentiality requirements), clarification (modification, updating), extraction, use, transfer (distribution, provision of access , including transfer to third parties with the right to process my personal data, including cross-border transfer), depersonalization, blocking, deletion, destruction;
• this consent may be provided to third parties as evidence that I have given my consent to the collection and processing of personal data to Unilactis distribution LLP (Unilactis Distribution).
